Duties of the County Attorney



In Texas, the duties of the County Attorney vary from county to county, and some counties, such as Bexar, do not have a County Attorney, just a District Attorney. Wilson County does not have its own District Attorney, but shares one District Attorney with four other counties, which together make up the 81st Judicial District. The 81st District Attorney prosecutes adults accused of committing felonies. Everything else that District Attorney's do in large counties, such as Bexar, is handled by the County Attorney. The County Attorney's duties include:


Civil Attorney for the County: The County Attorney advised Commissioners Court on civil legal matters, such as employment, elections, and subdivisions. Russell recently represented Wilson County by successfully defending Towing Truck Rules, which he drafted, in District Court, and before the 4th Court of Appeals in San Antonio.


Criminal Prosecution: Prosecutes all misdemeanor offenses committed by adults, except official misconduct.


Juvenile Crime: Prosecutes all crimes committed by a Juvenile, misdemeanors or felonies.


Family Violence: Represents the victims of family violence, by filing lawsuits in District Court, or County Court, to obtain protective orders.


Protecting Children and Disabled Adults. Represents the State of Texas in District Court, and Probate Court, in suits brought to protect children believed to have been abused, or neglected, or adults who are unable to care from themselves due to mental illness, or physical condition.
